PLEASE READ THE FOLLOWING CAREFULLY BEFORE DECIDING TO PURCHASE ANY SERVICES, UTILIZE ANY EQUIPMENT, OR PARTICIPATE IN ANY ACTIVITIES OFFERED BY RIGHTEOUS RIDES, LLC.

Your use or purchase of any equipment, access to any services or activities offered by or taking place on the premises of RIGHTEOUS RIDES, LLC (hereinafter “Provider”) is expressly conditioned upon your acceptance of the terms of this agreement. If for any reason You do not agree to the terms and conditions expressed herein, You should not sign this agreement and You should not proceed to access, purchase, rent, ride, or use any equipment or services offered by Provider or participate in any activities offered by Provider or taking place on the premises of Provider.

Participation in ATV riding and ATV-related activities exposes the participant to certain risks and dangers. Accidents and injuries (including fatalities) resulting from the forces of nature, other riders, malfunctioning equipment, unseen obstacles, fatigue, and your own misjudgment are very real possibilities. NO ATV-RELATED ACTIVITY IS WITHOUT RISK. Certain risks cannot be eliminated without destroying the unique character of the activity, and these risks may result in the loss of or damage to equipment, personal injury, illness, and in extreme cases, permanent injury or death.

Provider considers safety to be the utmost importance. The nature of ATV riding and all ATV-related activities, however, makes it impossible to foresee and protect participants from all conceivable dangers associated with ATV-related activities. Once a participant chooses to participate in any ATV-related activities, including renting an ATV on behalf of oneself or someone else, or renting or purchasing equipment or accessories for ATV-related activities, and all other activities on the premises of Provider, he/she must be prepared to assume all risks associated therewith.

By signing this document and initialing the required sections, YOU ARE EXPRESSLY AGREEING TO RELEASE Provider, its officers, agents, contractors, employees, successors, assigns, and affiliates (hereinafter "the Released") FROM ANY AND ALL CLAIMS, INCLUDING ACTIVE OR PASSIVE NEGLIGENCE BUT EXCLUDING GROSS NEGLIGENCE AND/OR INTENTIONAL MISCONDUCT, arising out of any act, omission, or condition existing prior to the signing of the agreement, and extending to include any act, omission, or condition in any way connected with your access to, use of or participation in any activities or services offered by Provider or on the premises of Provider (including transit to and from the facilities of Provider), occurring at any point in the future from access to, use of or participation in any activities or services offered by Provider or on the premises of Provider.

A. EXPRESS ASSUMPTION OF ALL INHERENT RISKS OF ATV-RELATED ACTIVITIES AND OUTDOOR ACTIVITIES

There are numerous risks inherent in and associated with participation in ATV-related activities and outdoor activities. By executing this RELEASE, You are acknowledging that participation in ATV-related activities and outdoor activities are inherently dangerous activities that involve risk of death and/or serious bodily injury that cannot be prevented or avoided even by the exercise of reasonable care. The following list, though not exhaustive, exemplifies many of the types of risks and potential injuries you could encounter in connection with your participation in ATV-related and outdoor activities:

ejection from ATV;
rollovers;
loss of control of any ATV;
mechanical failures;
collision with other riders or participants;
collision with ATVs, animals or vehicles whether owned or operated by the Provider;
collision with man-made or natural objects;
the negligent actions and/or omissions of other riders or participants;
your own actions and/or omissions, your level of competency as to the activity, as well as your own physical and mental conditions;
your sense of balance, physical coordination, and ability to operate equipment;
wind shear, inclement weather, lightning, variances and extremes of wind, weather and temperature;
collision, falling, slipping or other hazards that may result in injury or exposure to the elements;
the nature of the terrain, terrain hazards and your lack of familiarity with the terrain;
the presence of insects, wild animals, as well as dangerous plant life, bacteria, amoebas, and marine life forms;
equipment failure, improper use of equipment and/or impacting equipment;
heat or sun related injuries or illnesses, including sunburn, sun stroke or dehydration.

By initialing this section and executing this WAIVER below, You are agreeing that You have reviewed the preceding non-exclusive list of sample inherent risks involved in your access to and use of any services or equipment offered by Provider or participation in any ATV-related or outdoor activities offered by Provider or on the premises of Provider, and with full knowledge and understanding, You are voluntarily agreeing to access, use or participate in ATV-related or outdoor activities offered by Provider and to VOLUNTARILY AND EXPRESSLY ASSUME THE RISK OF SERIOUS BODILY HARM, PERSONAL INJURY, DEATH OR DAMAGE resulting from any and all inherent risks of your access to and use of any services or equipment offered by Provider or participation in any ATV-related or outdoor activities offered by Provider or on the premises of Provider (including transit to and from Provider facilities). By expressly assuming ANY AND ALL INHERENT RISKS involved with your access to and use of any services or equipment offered by Provider or participation in any ATV-related or outdoor activities offered by Provider or on the premises of Provider, You are voluntarily relinquishing the ability to seek or collect damages from the Released due to any personal injury, claim, or incident occurring or in any way related to or arising from the inherent risks of your access to and use of any services or equipment offered by Provider or participation in any ATV-related or outdoor activities offered by Provider or on the premises of Provider.

B. INDEMINITY AGREEMENT STATEMENT

By initialing this section and executing this WAIVER below, You are further agreeing to hold harmless and to indemnify the Released against any and all claims, demands, losses, damages, causes of action, judgments, costs, expenses, attorneys' fees, and other liabilities, including those from third parties, arising out of or relating to your access to and use of any services or equipment offered by Provider or participation in any ATV-related or outdoor activities offered by Provider or on the premises of Provider and/or your presence upon the property on which such activities are located, even if caused by the active or passive negligence of the Released, but excluding any gross negligence or intentional misconduct. By agreeing to indemnify the Released for the acts, occurrences, and expenses as contained within this subsection You are knowingly and voluntarily agreeing that You may be required to reimburse or provide the cost of a legal defense or representation for the Released for any expenses or actions it has to take arising out of your access to and use of any services or equipment offered by Provider or participation in any ATV-related or outdoor activities offered by Provider or on the premises of Provider. You hereby waive any and all claims against the Released and agree not to sue or bring any action against them for any injuries, illness, or damages sustained during any ATV-related or outdoor activities on the premises of Provider or in relation to your access to and use of any services or equipment offered by Provider or participation in any ATV-related or outdoor activities offered by Provider or on the premises of Provider.

C. WAIVER AND RELEASE OF LIABILITY

By initialing this section and signing this WAIVER below, YOU ARE AGREEING TO KNOWINGLY, VOLUNTARILY, AND UNEQUIVICALLY WAIVE ANY AND ALL CLAIMS, INCLUDING ACTIVE OR PASSIVE NEGLIGENCE BUT EXCLUDING GROSS NEGLIGENCE OR INTENTIONAL MISCONDUCT, against the Released arising out of any act, omission, or condition existing prior to the signing of the agreement, and extending to any act, omission, or condition in any way connected with your access to and use of any services or equipment offered by Provider or participation in any ATV-related or outdoor activities offered by Provider or on the premises of Provider (including transit to and from the facilities of Provider) occurring at any point in the future. THIS WAIVER AND RELEASE OF LIABILITY IS EXPRESSLY PROVIDED TO EXCULPATE THE RELEASED FROM THOSE LIABILITIES WHICH ARE SEPARATE FROM AND IN ADDITION TO THE POTENTIAL LIABILITIES CREATED BY THE RISKS INHERENT IN ATV-RELATED ACTIVITIES AND OUTDOOR ACTIVITY PARTICIPATION. Furthermore, by initialing and signing this waiver below, You are binding your spouse, heirs, assigns, and any similarly situated personal or legal representative to the waiver's terms.

D. DECLARATION OF COMPETENCY AND INTENT TO BE BOUND

By initialing this section and signing this WAIVER below, You are signifying that You have read first, then initialed, all sections contained within this agreement. You are further signifying that You are voluntarily agreeing to execute this waiver and release, and that You understand the legal implications and consequences of doing so. If there are any aspects of this agreement with which You do not have a full and complete understanding, You are encouraged to ask or inquire with the Released BEFORE initialing this section or signing this waiver.

E. AUTHORIZATION TO PUBLISH

Provider and its employees and agents have the right to take photographs, videotape, audio or digital recordings of You during any and all activities related to your access to and use of any services or equipment offered by Provider or participation in any ATV-related or outdoor activities offered by Provider or on the premises of Provider, and to use these in any and all media for any and all lawful purposes.

Provider reserves the right to elicit, accept, and publish feedback from You and any other party accessing, using or participating in ATV-related or outdoor activities offered by Provider or on the premises of Provider. You acknowledge and agree that feedback, reviews, opinions, and communications provided by You in any form, regarding your overall experience with Provider may be shared in print, digital, and electronic format, publicly or privately and/or for marketing purposes. You hereby authorize Provider, its agents, its employees, and its affiliates all rights to exhibit this recorded material in print, digital, and electronic format, publicly or privately and/or for marketing purposes. You acknowledge and agree that by accessing, using or participating in ATV-related or outdoor activities offered by Provider or on the premises of Provider, renting, purchasing, or otherwise accessing any equipment or service offered by Provider, You waive any and all rights, claims, or interests to control the use of your likeness, or identity in print, digital, and electronic format, publicly or privately and/or for marketing purposes.

F. APPLICABLE LAW

Any legal or equitable claim that may arise from participation in the above shall be resolved under the laws of the State of Florida, U.S.A.

G. UNCONDITIONAL GENERAL RELEASE FROM LIABILITY
